§ 1. General
DEUXSOEURS (Jürgs und Düring GbR), Blankenenser Bahnhofstrasse 33, 22587 Hamburg, owners Nele Jürgs and Imke Düring, info@deuxsoeurs.de (hereinafter referred to as "DEUXSOEURS" or "we"), operates at the Internet address (hereinafter "website") called) a concept boutique.
For all inquiries/orders placed via this website and for our deliveries and services, the following general terms and conditions apply exclusively in the version valid at the time of the order. Deviations from the provisions can only be made with our written consent.
§ 2 Conclusion of contract
1. The language available for concluding the contract is German. The delivery country (destination) is Germany.
2. The presentation of the goods on our website does not constitute an offer by deuxsoeurs to conclude a purchase contract.
The image rights belong to DEUXSOEURS, Jürgs and Düring GbR or their partners. Use without express written permission is not permitted.
Slight deviations from the catalog image and information may occur in handmade products.
3. By sending an order to us using the contact form provided on our website, you are making a binding offer to conclude a purchase contract with us. You submit the offer by entering all the required information during the process and finally sending the contact form to us by clicking the “Send” button.
4. Once we have received your order using the contact form you have sent, we will send you an email confirming receipt. Please note that this confirmation does not constitute a declaration of acceptance of your contract offer, but is merely for information purposes.
5. The purchase contract between you and DEUXSOEURS is only concluded when we accept the offer by sending the ordered goods. If you pay in advance, the delivery will only take place after the full amount has been credited to our account.
6. DEUXSOEURS is entitled to reject an offer from you without giving reasons, especially if there is reasonable suspicion that the goods purchased via the Internet are to be resold commercially.
§ 3 Cancellation policy
The right of withdrawal applies exclusively to consumers in accordance with Section 13 of the German Civil Code (BGB). A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.
RIGHT OF CANCELLATION
You have the right to cancel this contract within fourteen days without giving any reasons.
The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.
In order to exercise your right of withdrawal, you must inform us, DEUXSOEURS, Jürgs und DÜRING GbR, Blankeneser Bahnhofstrasse 33, 22587 Hamburg, Germany, by means of a clear declaration (e.g. a letter sent by post or by email) about your decision, to revoke this contract.
In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period has expired.
CONSEQUENCES OF CANCELLATION
If you cancel this contract, we will refund to you all payments received from you, including delivery costs (except for any additional costs arising from you choosing a method of delivery other than the cheapest standard delivery offered by us to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract.
For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment.
We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you notify us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired. We do not bear the costs of returning the goods.
You are only liable for any loss in value of the goods if this loss in value is due to the handling other than what is necessary to establish the nature, characteristics and functionality of the goods.

§ 4 Voluntary right of return
1. Regardless of your legal right of withdrawal, thecabinet.de offers you the following voluntary right of return:
All products from thecabinet.de can be returned to thecabinet.de within 14 days of receipt of the goods. However, the right of return only applies to unused, unwashed and perfect items from which the labels have not been removed.
CHRISTMAS
For Christmas orders we have extended the right of return to 30 days.
2.1. We do not cover the return shipping costs.
2.2. In the event of a return, a credit will be made to your account. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment.

This voluntary right of return does not limit your legal rights and therefore does not limit your right of withdrawal as set out above.
§ 5 Prices; product presentation; Availability; Gift Card; Promotion Code
1. The prices quoted by us to you at the time of your order apply.
2. The goods offered at deuxsoeurs.de are presented on the website (or photos sent to you by DEUXSOEURS) in the form of digital photographs of the actually existing goods. Minor differences between the representation and reality do not constitute a defect in the ordered goods.
3. If you have ordered several products at the same time, the individual products may be delivered at different times. § 266 BGB remains unaffected. Shipping costs are only charged once here.
4. Gift Card
4.1 The Gift Card is valid for an unlimited period of time from the date of purchase and is applicable to the purchase of all items except other Gift Cards.
4.2 The exchange or payment of your Gift Card is excluded outside of the statutory return and withdrawal rights to which you are entitled.
4.3 The Gift Card is available in the respective currency € and can only be redeemed in Germany.
4.4 When purchasing the Gift Card, you can choose between two options: Either Gift Card by email or Gift Card by post.
4.5 Once you have received the Gift Card, DEUXSOEURS assumes no responsibility for lost, stolen, destroyed or illegally redeemed Gift Cards. In the case of gift cards sent by email, DEUXSOEURS assumes no liability for typographical errors in the email address of the voucher recipient.
4.6 DEUXSOEURS reserves the right to cancel or block the Gift Card if there is a legitimate reason for such action, for example in the event of loss or misuse of the Gift Card. DEUXSOEURS will inform you about the cancellation or blocking of the Gift Card.
5. Promotion Code
5.1 Promotion codes have different durations and are applicable to the purchase of all items except gift cards. The specific duration of your promotion code can be found in the document that also contains the promotion code.
5.2 The exchange or payment of promotional codes that you have received from DEUXSOEURS as part of marketing campaigns or as a gesture of goodwill is excluded. A payout of other promotional codes is also excluded outside of the right of return and withdrawal to which you are legally entitled.
5.3 Once you have received the promotional code, DEUXSOEURS assumes no responsibility for lost, stolen, destroyed or illegally redeemed promotional codes.
5.4 DEUXSOEURS reserves the right to cancel or block the promotional code if there is a legitimate reason for such action, for example in the event of loss or misuse of the promotional code. DEUXSOEURS will inform you of the cancellation or blocking of the promotional code.
5.5 Information on returning items from orders with promotional code:
If you make use of your right of withdrawal or the voluntary right of return, you will be refunded the reduced purchase price. If you cancel or return an item from an order that originally contained multiple items, the value of the promotional code will be deducted pro rata from the total price of the item and you will receive the appropriate refund. The promotional code expires in proportion to the value of the returned item. If you cancel or return all items, the promotional code will expire and the original amount paid will be refunded. There is no right to a refund or replacement of a promotional code from a promotion.

§ 7 Delivery & Shipping
1. Shipping is usually done with DHL. There is a possibility. The transport risk is borne by DEUXSOEURS .2. Unless otherwise noted, the goods are ready for dispatch on the day following each working day after receipt of your order. If you pay in advance, delivery will only take place after the full purchase price has been credited to our account.3. Shipping costs with delivery country Germany
The shipping costs are staggered depending on the order value:
€1.00 - €9.99 = €2.50
€10.00 - €49.99 = €4.95
Shipping is free for orders over €50.00.
Delivery time: 1-4 working days depending on delivery location.
For partial shipments, shipping costs are only charged once.
§ 8 Payment; late payment; On Bill; Right of retention
You can currently pay for your order at DEUXSOEURS via Paypal or bank transfer.
By Visa, Mastercard, American Express and EC card only in store. Currency in euros. This also works without registering with Paypal..
2. Payment by Gift Card
2.1 Payment by Gift Card is made by informing DEUXSOEURS. If the order value exceeds the value of the Gift Card code, you must also select one of the payment methods offered with which you want to pay the remaining amount. If the value of the Gift Card code is higher than the order value, you can reuse the same code for your next purchases until the Gift Card balance is completely used up. A cash payment for the Gift Card is not possible.
4. Offsetting
Offsetting by the customer is excluded if the counterclaim has not been legally established, ready for decision or undisputed or includes a claim for compensation for defect removal costs from the same contractual relationship.
5. Right of retention in commercial transactions
In commercial transactions, the buyer's right of retention and right to refuse performance are excluded, with the exception of undisputed, legally established counterclaims or claims arising from the removal of defects from the same contract.
§ 9 Retention of title
The delivered goods remain the property of DEUXSOEURS until full payment has been made.

2. Liability for fraudulent concealment of defects or acceptance of a quality guarantee as well as liability for claims based on the Product Liability Act as well as for damages resulting from injury to life, body or health remain unaffected. This does not involve a change in the burden of proof to the detriment of the customer.
3. With the exception of claims arising from unlawful acts, the customer's claims for damages, for which liability is limited according to this section, expire one year from the start of the statutory limitation period.
4. To the extent that DEUXSOEURS' liability is excluded or limited, this also applies to the personal liability of employees, employees, employees, representatives and vicarious agents.
